COMENOWTHESEPARTIES, the Seller and Purchaser identified above, both of whom state that they are

over the age of majority, that they are bona fide residents ofthe same state asspecified in the physical

addresses listed for each party above, that they have personalknowledge of the facts herein stated, and

that they are otherwise competent to make this statement underoath:

2.Selleraffirmsthathehasnoknowledgeof,orreasontobelievethatthereisanylegalorequitable

impediment to his transferofthe firearm described above; and that he acquired the firearm in a lawful

manner and is the legitimate owner thereof.

3.Purchaseraffirmsthathehasnoknowledgeof,orreasontobelievethatthereisanylegalorequi-

table impedimentto hisownership, possession,or receiptof the firearmdescribed above; thathe is not

prohibitedby the provisionsof Chapter 44ofTitle18, United States Codefrom receiving afirearmin

interstateorforeigncommerce; thathisreceiptofthisfirearmwillnotbeinviolationofanystatuteof

hisstateofresidenceorofanypublishedordinanceapplicabletothelocalityinwhichheresides;and

thatheislawfullyentitledtopurchasethesameandthatheisacquiringthehandgunforhispersonal

use and not in contemplation of the sale ortransfer of the handgun to any other person.

4.Neither Party isa "dealer"asthat termisdefined in27C.F.R.§478.11 orotherwise licensed tosell

firearms at retail.

This document contains the instructions for use of the "Affidavit and Billof Sale" form.These instruc

tions mustbe followed to the letter for transfer of handguns unless otherwise stated; a failure to use the

form properly can result in seriouslegal problems, including criminalprosecutions.Long gunshave

more liberal rules, but we strongly suggest that you follow the same procedure.

1.Theformisdesignedtofacilitatethetransferofahandgunbetweenprivateparties,neitherof

whomisinthebusinessofbuyingandsellingfirearms,andneitherofwhomislicensedasadealerin

firearmsbytheBureauofAlcohol,Tobacco, Firearms,andExplosives("BATFE").Itisalsodesigned

toprovidedocumentationofownership,forexampleif thegun shouldbe lost,stolenordestroyedand

theownerhastobeabletomakeareporttolawenforcementoraninsurancecompany,orevento

prove ownership for a subsequent transfer to another person.

2.Both theseller and the purchasermust be actual residents of thesame state at thetime of the trans-

action.Itispossible,underBATFEregulations,foronepersontobearesidentofmorethanone

state,butatthetimeofthetransaction,hemustbeactuallyresidinginthesamestateastheother

party.Inafacetofacetransaction,bothpartiesshouldinspecttheidentificationoftheothertoverify

thatthepropernameandaddresswasusedontheform,andcheckapicture-idifpossibletoconfirm

the identity of the other party.If any aspect of the transaction is questionable, don't go through withit

until the confusion is cleared up.

3.Theformfunctionsasanaffidavit,whichcanbeusedtojustifytheshipmentofahandguntoa

non-federalfirearmslicenseewithinthesamestate.Thismustbedoneusingacommoncarrier,such

asFederalExpressorUPS.Handgunscannotbemailedbynon-licensees(USPSDomesticMail

ManualRule11.1.2).TheGunControlActof1968,section992,makesitacrimeforanonlicensee

toshipafirearm"ininterstatecommerce"whichbasicallymeansbeyondthebordersofhisstateof

residence.Forprotectionofthesellerfromprosecution,shipmentofahandgunfromoneprivate

partytoanotherwithinthesamestateshouldbedone,if,andonlyif,theaffidavithasbeenexecuted

first,andtheshipperhasanoriginaloftheaffidavitinhispossessionpriortotheshipment.Thereis

nofederalrecordkeepingrequirement,andthisaffidavitisdesignedonlyfortheprotectionofthe

parties from legal attacks on othergrounds.

4.Theuseoftheaffidavitcanprovideareasonablebasisfortheassertionthatthesellerdidnothave

reasonto know thatthe purchaser wasinreality notentitledto purchase a handgun.It is nota wayof

gettingaroundtherequirementthatthesellerhaveagoodfaithbeliefthatthepurchaserwasnot

violatingthelawbyhisacquisitionofthefirearm.Itisreasonabletorelyonthepurchaser'ssworn

statement,unlessanduntilthesellerhasknowledgeofotherfactsnotstatedwithintheaffidavitwhich

effectivelygivehimactualnotice thatthepurchaserisnotentitledtopurchaseahandgun.Forexam-

ple,ifsomeonehappenstomention,"IthinkIknowthatguy;Ithinkthathewasconvictedofarmed

robberytenyearsago.",thatgivesrisetoadutytocheckonthefacts,notwithstandingtheaffidavit.

Inacaselikethat,andwherethepurchasersays"IlivedinOklahoma,butthatwasnotme.",have

himgetacriminalbackgroundcheckfromwherehelivedinOklahomaandshowyouthathewas

neverconvicted,orelseexecutethetransferthroughafederalfirearmslicenseewhocangetthe

purchaser to fill outthe standard form andsubmit to an NICS check.

5.Note thatthetermsstate that the only thing theSellerispromisingisthat heactually ownsthegun

and haslegal authority to sellit.It is assumed that the Purchaser is aware that heis buying a usedgun

from a person who gives no warranty, and has negotiated the price he's willing to pay accordingly.

6.Notallofthefieldslistedunder"identification"needtobefilledout-gunsmadeintheU.S.will

nothavean"importer",forexample.Butalloftheinformationnormallyrequiredforadequateiden-

tification should be available and should be filled out completely.
